Blaine Divorce Filing Steps

Filing for divorce in Blaine follows Minnesota state law under Chapter 518 of the Minnesota Statutes. The process starts when one spouse files a Petition for Dissolution of Marriage and a Summons at the Anoka County District Court. The other spouse then gets served with these documents. Both spouses can also file jointly if they agree on all terms.

Before you file, check the residency rule. Under Minn. Stat. § 518.07, at least one spouse must have lived in Minnesota for 180 days. If you have been in Blaine for at least six months, you meet this test. Minnesota is a no-fault state. You only need to show that the marriage is broken beyond repair, per Minn. Stat. § 518.06. No other grounds are needed.

Uncontested cases where both sides agree move fastest. The court reviews the agreement and issues a decree without a trial. Contested cases may involve mediation, hearings, and possibly a trial. When kids are in the picture, both parents must take a parenting education class under Minn. Stat. § 518.157. A parenting plan that covers custody and time with each parent is required. Child support follows the state guidelines worksheet, which takes both incomes into account along with the parenting time split.

Anoka County has a self-help center at the courthouse to assist people who are filing for divorce without a lawyer.

Property and Support in Blaine Divorces

Property division in Blaine divorce cases follows Minn. Stat. § 518.58. The court divides marital property in a way it considers fair. This does not always mean a 50/50 split. The judge looks at the length of the marriage, each spouse's income and contributions, and the needs of each person going forward. Debts are also part of the equation. Anything one spouse owned before the marriage or got as a gift or inheritance is usually treated as non-marital property and stays with that person.

Spousal maintenance, or alimony, can be awarded under Minn. Stat. § 518.552. The court considers whether one spouse lacks the income to meet basic needs after the divorce and whether the other spouse can afford to pay. Maintenance can be temporary or long-term depending on the situation. Not every divorce includes maintenance. It depends on the facts of the case.
